You must obtain permissions from your parent(s) or legal guardian(s) in order to create or use an account on the Platform if you are under the legal age or in any circumstances, are not fit to provide your consent hereunder pursuant to the applicable laws in your country. If you are the parent or legal guardian of a minor or disabled individual who is creating an account or accessing the Platform, you must accept and comply with Alcea Digital Terms and Conditions on behalf of the minor or disabled individual. You will be responsible for said individual’s actions and any charges associated with the use of the Services made on the Platform.
By accessing these Services, you agree:
that you have read and understood the contents of Alcea Digital Terms and Conditions and agree to be bound by Alcea Digital Terms and Conditions;
Alcea Digital Terms and Conditions constitute a legal agreement between you and ALCEA DIGITAL SDN. BHD (CO.NO: 1334968-V) a company duly incorporated and registered in Malaysia (“Alcea”, “we”, “us” or “our”);
Alcea reserves the right to change, modify, add, or remove portions of Alcea Digital Terms and Conditions at any time and, you agree to be bound by Alcea Digital Terms and Conditions and any changes made thereafter to the Alcea Digital Terms and Conditions;
to adhere and comply with all applicable laws and regulations;
that the materials contained in Alcea Digital’s Platform are protected by applicable copyright and trademark laws;
in the case of any violation of Alcea Digital Terms and Conditions, Alcea Digital reserves the right to seek all remedies available by law and in equity for such violations;
these Services may require your registration or subscription. Should you choose to register or subscribe for the Services, you agree to provide accurate and current information about yourself, and to promptly update such information if there are any changes. You shall be solely responsible for keeping your passwords and other account identifiers safe and secure. You shall be entirely responsible for all activities that occur under your password or account and shall promptly notify Alcea Digital of any unauthorized use of your password or account. Alcea Digital shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section;
Alcea Digital may, from time to time without giving any reason or prior notice, upgrade, modify, suspend or discontinue the provision of or remove, whether in whole or in part, the Services and shall not be liable if any such upgrade, modification, suspension removal prevents you from accessing the Services; and
Alcea Digital reserves the right at its absolute discretion and as deemed fit to:
monitor, screen, or otherwise control any activity, content, or material on the Platform and/or through the Services;
investigate any violation of Alcea Digital Terms and Conditions and take any action it deems appropriate;
prevent or restrict access of any user to the Platform and/or for the Services;
report any activity it suspects to be in violation of any applicable law, statute, or regulation to the appropriate authorities and to co-operate with such authorities; and/or
to request any information and data from you in connection with your use of the Services at any time and to exercise our rights under this paragraph if you refuse to divulge such information and/or data or if we have reasonable grounds to suspect that you have provided inaccurate, misleading or fraudulent information and/or data.
3. Use of Platform
Alcea Digital authorizes you to view materials published by Alcea Digital on Alcea Digital’s Platform solely for your personal and non-commercial transitory viewing only in support of the Services provided by Alcea Digital.
4. Disclaimer
The materials on Alcea Digital’s Platform are provided on an “as is” basis without warranty of any kind either expressed or implied. Alcea Digital, its agent, partners or suppliers disclaims all warranties, expressed or implied, including, without limitation, those of merchantability, fitness for a particular purpose and infringement of intellectual property or other violation rights or arising from a course of dealing, usage, or trade practice. You acknowledge and agree that:
Alcea Digital disclaims and negates all warranties, assumes no responsibility or makes no representations concerning the accuracy, likely results, or reliability of the use of the materials on Alcea’s Platform or otherwise relating to such materials or on any linked sites;
Alcea Digital may change the programs, Services, or information mentioned at any time as deemed fit without providing any notice or reasons to you;
The information provided on the Platform may contain errors and may include information on projections or future events;
Alcea Digital’s Platform may contain links to third party sites which does not imply endorsement by Alcea Digital of the Platform site and may be provided merely for convenience. Alcea Digital shall not be responsible for the contents, accuracy, or reliability of any such linked site or the information and the use of any such linked website is at your own risk;
Alcea Digital cannot guarantee that the Services will be free of any grammatical errors and will be accurate to your expectations;
Alcea Digital shall not be liable to you for any damages resulting from lost profits, lost data, or business interruptions arising out of the use, inability to use, or the results of use of this Service or the materials or information or services contained at any or all such sites, whether based on warranty, contract, tort, or any other legal theory and whether or not advised of the possibility of such damages; and/or
if your use of the materials, information, or Services from this Platform results in the corruption of your computer or need for servicing, repair, or correction of equipment or data, you shall bear all costs thereof.
5. Limitations
In no event shall Alcea Digital, its officers, employees, directors, agents, partners, contractors, assigns, or suppliers be liable to you or your representatives for any damages including, without limitation, loss of profits, consequential, or incidental damages including, without limitation, loss of profits or revenues, loss due to business interruption, costs of replacement goods, loss or damage to data or health arising out of the use or inability to use the Platform and/or Services even if Alcea Digital or its representatives have been notified or advised of the possibility of such damages.
6. Access to Password Protected/Secure Areas
Access to and use of password protected and/or secure areas of the Platform is restricted to authorised users only. Unauthorised individuals attempting to access these areas of the Platform may be subjected to claims and damages together with necessary action from Alcea Digital which could include suspension, termination, and imposition of a penalty.
7. Governing Law
The Platform is controlled by Alcea Digital from its offices in Federal Territory of Kuala Lumpur, Malaysia. As such, these Terms and Conditions shall be interpreted and governed by the laws in force in Malaysia without regard to its conflict of law will govern these Terms and Conditions and any claim or dispute that has arisen or may arise between you and Alcea Digital except as otherwise stated in these Terms and Conditions. If the Platform is accessed from a location outside of Malaysia, it is done at your sole risk and discretion with the understanding that laws applicable in a foreign location may not be applicable to the Platform.
8. Online purchases of publication and/or Services
You acknowledge and agree that:
you shall be liable for all transactions and orders submitted under your username and password;
if you know or suspect that another person(s) is using your password, you should notify Alcea Digital immediately, and if Alcea Digital believes that there is likely to be a breach of security or misuse as such, Alcea Digital may require you to change your password or suspend your account and/or take the necessary action accordingly as deemed fit.
Alcea Digital reserve the rights to accept, refuse, or cancel your order for any reason as deemed fit;
should there be any ambiguity in your order placed with Alcea Digital, Alcea Digital may deem fit to resolve the issue by contacting you for any additional information before processing your order;
the prices to be paid for the Services that you order will be set out in Alcea Digital’s Platform. The prices published on Alcea Digital’s Platform may differ when the order is placed;
although Alcea Digital aims to offer you the best service possible, Alcea Digital makes no promise that the Services at Alcea Digital’s Platform will meet your requirements. Alcea Digital cannot guarantee that the Services will be fault-free and will meet your requirements. If a fault occurs, you should report it to Alcea Digital;
your access to Alcea Digital’s Platform may be occasionally limited to allow for repairs, maintenance, or the introduction of new facilities or services. Alcea Digital will attempt to reinstate the service as soon as it reasonably can; and/or
Alcea Digital will deliver its Services to you by electronic method or any other means as deemed fit by Alcea Digital. Alcea Digital will let you know if there are any changes with your order via email, text, or phone.
9. Reviews and Comments
You acknowledge and agree that:
Anything submitted or posted on Alcea Digital’s Platform including without limitation, ideas, know-how, techniques, questions, reviews, comments, and suggestions are and will be treated as non-confidential and non-proprietary, and Alcea Digital shall have the royalty-free, worldwide, continuous, unchangeable and transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, create derivative works from such posting or submissions by any means and in any form, and to translate, modify, reverse-engineer, disassemble, or recompile such posting and/or submission. All postings and/or submissions shall automatically become the sole and exclusive property of Alcea and it will not be returned to you.
When you post comments or reviews to Alcea Digital’s Platform, you also grant Alcea Digital the right to use the name that you submit with any review, comment or other content, if any, in connection with such review comment, or other content.
You further represent and warrant that you own, or otherwise, have control all of the rights to the reviews, comments and other content that you post on Alcea Digital’s platform, and that you use of your reviews, comments, or other content by us will not infringe upon or violate the rights of any third party. You shall not use a false email address, pretend to be someone else other than yourself or otherwise mislead us or third parties as to the original of any posting and/or submission.
Alcea Digital may, as deemed fit, remove or edit any posting and/or submissions (including comments or reviews) for any reason without any notification to you.
10. Terms and Conditions on purchase of Electronic Coins (“Coins”) from Alcea
Payment for the Services purchased from Alcea Library shall be by way of redemption of coins purchased from Alcea Library and/or any other method by Alcea Digital as deemed fit by Alcea Digital. You acknowledge and agree:
To be bound by Alcea Library’s coin purchase and redemption terms and conditions including but not limited to the relevant provisions in Alcea Digital Terms and Conditions as mentioned in Clause 2.1.
Alcea Digital reserves the right to withdraw or cancel the coins for any at any time as deemed fit.
Alcea Digital shall not be liable to you or to your household for any financial loss arising out of the refusal, cancellation, termination, withdrawal and/or expiration of the coins or any failure or inability of you or your household to use the coins for any reason.
11. Indemnity
You agree to indemnify and hold harmless Alcea Digital and its affiliates from and against any and all claims, damages, costs and expenses, including solicitors’ fees, arising from or related to your use of the website or any breach by you of these Terms and Conditions or any of the Alcea Digital Terms and Conditions.
12. Electronic Communications

When you use any of Alcea Digital’s services, or send an email to us, you are communicating with Alcea electronically. You also consent to receive communications from Alcea Digital electronically or by any means as deemed fit by Alcea Digital. You also agree that all agreements, notices, disclosures and other communications that Alcea Digital provides to you electronically satisfy any legal requirement that such communications be in writing and on the mode of communication to you.
13. Termination and Effect of Termination
In addition to any other legal or equitable remedies, Alcea Digital may, without prior notice to you, immediately terminate these Terms and Conditions or repeal any or all of your rights granted under these Terms and Conditions. Upon any termination, you shall immediately cease all access to and use of the platform, and Alcea shall, in addition to any other legal or equitable remedies, immediately repeal all password(s) and account identification issued to you and deny your access to and use of this website in whole or in part. Any termination of these Terms and Conditions shall not affect the respective rights and obligations of the parties arising before the date of termination.
14. Order Cancellation
Your order begins processing immediately after you click “Confirm” after redeeming the coins. Upon which you will not be able to cancel your order although you have not received the Publication or Services. You acknowledge and agree that:
Alcea Digital may cancel your order for various reasons as deemed fit by Alcea Digital. In every instance, Alcea Digital shall make every effort to communicate with you prior to cancelling the order. Alcea Digital sincerely apologises if your order is cancelled without your knowledge;
The most common reason why your order can be cancelled without your consent is that the information about yourself is incorrect and you are not contactable or you have not made the payment for the purchase;
Cancelled orders cannot be reinstated;
For all scenarios Alcea Digital will send you a notification, so please check your email regularly (including “Junk” and “Spam” mail folders); and/or
If you have any other questions or concerns about your order cancellation, please contact Alcea Digital.
15. Refund and Exchange
You acknowledge and agree that:
Any refund and exchange on the Services shall be governed by this Clause 15 and Clause 16 on Alcea’s Refund Policy below.
The services purchased shall not be returnable, exchangeable, and there will be no refund.
Alcea Digital will not accept any request to refund for any reasons.
An exchange can be done if the Services purchased do not match the description, strictly provided that the request for exchange is made within 24 hours of the receipt of the Services from Alcea Digital. If the said product is no longer available, Alcea Digital will issue a credit voucher or return the coins to the account with the same amount as the product that was redeemed.
Services or coins cannot be exchanged for cash.
16. Refund Policy
We recommend that prior to any purchase, should you have any questions regarding the contents, materials or products you are ordering, please email us at: help@alceadigital.com.
You acknowledge and agree that:
we shall not accept any request for refund, save and except if we believe such content and materials purchased cannot be downloaded due to technical error from us and/or the content creator and/or materials’ providers.
you may request for an exchange if the contents or materials purchased do not match the description, strictly provided that the request for exchange is done within 24 hours of receipt of such content and material from this website. If the said products, contents or materials are no longer available, we will issue credit voucher, or, if such purchased was made by coins, we will refund the coins back into the same account with the same amount as the product was redeemed.
under any circumstances, the credit voucher or coins cannot be exchanged with cash.
any payment surcharges applied to your order during payment are non-refundable.
we also cannot take responsibility or grant a refund if we choose not to redeem your code, for whatever reason.
we reserve the right not to issue or to remove or deduct from your account, any credit voucher and/or coins, if for whatsoever reason, we reasonably believe that:
such request of refund is bogus;
such refund is an unauthorised refund; and
such refund was made by mistake.
17. Price and Tax
Prices displayed on Alcea Digital’s Platform are exclusive of any taxes or other charges.
Prices may differ from the redeemed amount.
Alcea Digital does not accept cash payments.
Alcea Digital’s liability to you in connection with any other will not exceed the total price charged for the relevant items.
18. Alcea’s Privacy Policy
Alcea Digital respects your privacy. We want to make use of individual identifying information that you provide to us for purposes of serving you better. “Individual identifying information” is information that enables us to identify you, such as your email address, name, title, and address. Alcea Digital uses the individual identifying information in order to personalise your experience on our Platform and also to be able to selectively send you communications that may be of interest to you, either electronically or otherwise.

14. Order Cancellation

Any refund and exchange on the Services shall be governed by this Clause 15 and Clause 16 on Alcea’s Refund Policy below.
The services purchased shall not be returnable, exchangeable, and there will be no refund.
Alcea Digital will not accept any request to refund for any reasons.
An exchange can be done if the Services purchased do not match the description, strictly provided that the request for exchange is made within 24 hours of the receipt of the Services from Alcea Digital. If the said product is no longer available, Alcea Digital will issue a credit voucher or return the coins to the account with the same amount as the product that was redeemed.
Services or coins cannot be exchanged for cash.
